Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Swipemapp mobile application and related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you and Swipemapp (“Swipemapp,” “we,” “us,” or “our”) governing your access to and use of the Service, including the mobile application, website, and all related features and content.

By creating an account or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years of age to use the Service. Users in the European Union or the United Kingdom must be at least 16 years of age, or have verifiable parental consent. By using the Service, you represent and warrant that you meet the applicable age requirement.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To use most features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account password and not share it with others
  • Promptly update your account information if it changes
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in prohibited conduct.

4. User Content

4.1 Your Content

The Service allows you to post, upload, and share content including text, photos, videos, voice messages, and other materials (“User Content”). You retain ownership of your User Content.

4.2 License Grant to Swipemapp

By posting User Content, you grant Swipemapp a non-exclusive, royalty-free, worldwide, sublicensable, and transferable licence to use, host, store, reproduce, modify (for formatting purposes), distribute, and display your User Content solely for the purpose of operating, promoting, and improving the Service. This licence ends when you delete your content or account, subject to any copies already distributed to other users.

4.3 Content Standards

You are solely responsible for your User Content. You represent and warrant that your content:

  • Does not violate any applicable laws or regulations
  • Does not infringe the intellectual property, privacy, or other rights of any third party
  • Is not false, misleading, defamatory, obscene, or hateful
  • Does not contain malware, viruses, or harmful code
  • Is not spam or unsolicited commercial communications

4.4 Content Moderation

We use automated moderation tools and human review to enforce our content policies. Content that violates our policies may be removed without prior notice. Repeated violations may result in account suspension or termination. You may appeal moderation decisions by contacting support@swipemapp.com.

5. Prohibited Conduct

You agree not to:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Post sexual content involving minors in any form
  • Bully, harass, stalk, or intimidate other users
  • Impersonate any person, business, or entity
  • Collect personal information about other users without consent
  • Use the Service to send unsolicited messages or spam
  • Attempt to gain unauthorised access to any account or system
  • Interfere with or disrupt the Service or its servers
  • Use automated tools to scrape, crawl, or extract data from the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Promote or facilitate illegal activities
  • Use the Service for commercial purposes without our written consent
  • Create multiple accounts to evade a ban or restriction

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the app design, code, graphics, trademarks, and logos — are the exclusive property of Swipemapp or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

If you believe any content on the Service infringes your copyright, please contact us at legal@swipemapp.com with a description of the allegedly infringing content and your contact information.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our collection and use of your information as described in the Privacy Policy.

8. Third-Party Services

The Service integrates with or links to third-party services, including:

  • Google Sign-In and Apple Sign-In for authentication
  • Amazon Web Services (AWS) for cloud infrastructure and media storage
  • Apple Push Notification Service (APNS) and Google Firebase Cloud Messaging (FCM) for notifications
  • Third-party mapping services for the interactive map feature

Your use of these third-party services is governed by their own terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. We make no warranties about the accuracy, reliability, or completeness of any content on the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWIPEMAPP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM:

  • Your access to, use of, or inability to use the Service
  • Any content obtained from the Service
  • Unauthorised access to or alteration of your transmissions or content
  • Conduct of any third party on the Service

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Swipemapp and its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another person or entity

12. Termination

You may delete your account at any time in the app under Settings → Delete Account. Upon deletion, your access to the Service will be revoked and your content will be deleted in accordance with our Privacy Policy.

We may suspend or terminate your account at any time, with or without notice, for violating these Terms, engaging in illegal activity, or for any other reason at our sole discretion. We will attempt to notify you where feasible.

Provisions of these Terms that by their nature should survive termination will survive, including Sections 4.2 (License), 6, 9, 10, 11, and 13.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in the jurisdiction where Swipemapp is registered, unless otherwise required by applicable consumer protection laws in your jurisdiction.

14. Dispute Resolution

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute with us informally by contacting support@swipemapp.com and giving us 30 days to respond. Nothing in this section prevents you from seeking urgent injunctive relief.

If you are an EU consumer, you may also submit a complaint to your local consumer protection authority or use the European Commission's Online Dispute Resolution platform.

15. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will notify you via a notice in the app or by email at least 15 days before the changes take effect. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
